PUBLIC EXPRESSION OF RELIGION ACT

American Legion Resolution 326 was adopted at the 2004 American Legion National Convention.  
     
Resolution 326 calls on Congress to amend the Civil Rights Attorney Fees    
Act, 42 U.S.C. Section 1988, to end the authority of judges to award taxpayerpaid    
attorney fees to the ACLU, or other litigants, in cases brought under the    
Establishment Clause against the Boy Scouts, or the public display of the Ten    
Commandments or other symbols of our American religious history, including    
veterans memorials, as in the despicable Mojave Desert Veterans Memorial    
Case.    
The Public Expression of Religion Act of 2005, H.R. 2679 (PERA)    
introduced by Rep. John Hostettler (R-lnd.), is pending before the Judiciary    
Committee.    
H.R. 2679 (PERA) when enacted into law, will do everything The American    
Legion asks for in Resolution 326: It will stop the ACLU from receiving    
literally millions of dollars in taxpayer-paid attorney fee awards ordered    
by judges in "Establishment Clause'' cases. H.R. 2679 will not affect any    
other kind of civil rights cases.    
     
We Legionnaires can make this happen. Please call or write your    
Congressional representative and Senators to voice your support for passage of    
H.R. 2679. Once Americans know there is a solution to stopping frivolous legal    
attacks on our values, religious icons, and veterans' memorials, they too will    
flock to support this legislation.
